INSPECTION OF THE WORK GIVES US THE REASON AND FORCES CAMBRAY TO DO THE REVISION MEDICINE FOR EDUCATION WORKERS

The affiliates of the Teaching Union Section of the Various Activities Union of Vallès Oriental have asked the Public Administration to require the Department of Education of the Generalitat of Catalonia to carry out the corresponding and normative annual medical check-up a tots i totes les treballadores al seu càrrec, in compliance with the Statute of Workers and the Law on the Prevention of Occupational Risks, since he has been neglecting it for several years. In some educational centers more than a decade, with the added severity of neglect during the critical pandemic period.
The strategy used has been to make an individual report to the Labor Inspectorate [the complaint is confidential].

As a result of our complaints, the Labor Inspectorate is starting to intervene ONLY IN THE EDUCATIONAL CENTERS WHERE WE REPORT, obliging the Department of Education of the Generalitat to carry them out.

I PRESENT:
That in compliment of the Article 4.2 of the Workers' Statute and the articles 14 i 22 of the Law 31/1995, from 8 of November, de Prevención de Riesgos Laborales all companies should carry out an annual medical examination for all workers in their centers.
That the Department of Education of the Generalitat de Catalunya has been for years, in some cases up to a decade, without fulfilling this responsibility with the workers who depend on them, in all the provinces of the Autonomous Community of Catalonia.

SUN LAWFUL:
– That your institution requests the corresponding documentation from the Department of Education of the Generalitat de Catalunya.
– That your institution put an end to this negligent action that attacks the right to occupational health of workers.
– That your institution investigates the causes of this violation and establishes responsibilities.
– That from this same course 2022-2023 and henceforth the Department of Education of the Generalitat de Catalunya complies with its obligation to guarantee the corresponding annual medical check-up for all the workers in its centers, or to its centers and/or organizations that depend on them, are hired directly, o no. However, exercise the corresponding proactive responsibility in cases where results among its workers require it.
