5 years of labor counter-reform: The fallacy of job creation and the rule of 3×2

Vidal Aragones, labor lawyer of the Ronda Collective, analyzes the statistical data that confront and radically refute the thesis defended by the PP government that the labor reform approved in 2012 has contributed to the creation of employment while demonstrating that the only effect deployed by the rule has been the extension of precariousness and the generalized degradation of working conditions.

We had to wait until January 2017 (17.674.155) to exceed the number of contributors previous to 2012, although still far from the 19,161,851 contributors registered in the year 2008.

SUCCESS OF THE BARCELONA BICING STRIKE

In the first of 15 days called during the Bicing strike, today 12 July, the follow-up of the mobility strike, maintenance and workshop has been from 100%. Both the morning picket and the rally in Plaça Sant Jaume in Barcelona were very crowded. In the afternoon there is a call during the strike hours, from 16 a 18 hours, another concentration of 17 a 19 in Sant Jaume.

In it 2017 the Bicing workers have started a fight to reverse a situation that has been dragging on since its beginnings in the 2006. In July of 2006 Barcelona City Council issues a tender for the management of the Bicing activity in the city for 55.000.000 euros, was awarded to Clear Channel, American multinational, in December of 2006 only for 22.495 640, that is to say, less than half of what, according to the studies carried out by the City Council, it cost to implement Bicing. In turn Clear Channel outsourced it to another company. The consequences of this economic reduction in initial investment, they fell on the workers and their economic and health conditions, extending to the present day.

In it 2006 the excuse for having a workforce in precarious conditions was that the activity was new and had to be consolidated. To all the workers who tried to denounce the situation and organize themselves, they were immediately dismissed, labor insecurity in the company has been festering for years. Bicing is now consolidated and this excuse does not hold.

In it 2017 the situation is similar. It is providing the Clear Channel service provisionally and a tender is being held from the town hall for 10 years, 2018 al 2028, with a total amount of 227.568.148 euros that are awarded in September of this year. The annual cost is 22.756.824 euros, and the part dedicated to salary costs is of 4 365.773 of euros that is to say the 19 % of the tender, in which the managers and coordinators of the company are included and which they take alone 1.100.000 d'euros. No company devotes only such a small amount to salary costs. We believe that the costs allocated to workers' wages are totally insufficient and the consequences are very low wages and a lack of investment in occupational risk prevention materials.

From the CGT we hold the Clear Channel company responsible for this situation for having presented such low figures that served as the basis for the tender, and to Barcelona City Council for not verifying that these numbers are being used to pay a pittance and to carry out the tender without the relevant checks, both economic and in terms of occupational risk prevention.

The CGT considers that some of the options to alleviate this business and city council "error" can be to make a change in the tender, in the wage bill, guaranteeing that workers are paid decent wages and that resources are allocated to prevention or that the tender is withdrawn and another is published, solving the deficiencies that have been detected. These proposals are feasible and all that is needed is the will on the part of the company and the city council.

We remain open to dialogue aimed at finding a definitive solution that eradicates precariousness in Bicing, meanwhile we will continue to mobilize so that we are heard. This situation, known both by the company and the City Council, cannot continue.

The rest of the strike days of 4 hours are called on the days 12,14,15,16,17,19, 21, 22, 23, 24, 26, 28, 29, 30 i 31 July. Friday 14 of July there will also be rallies in Plaça Sant Jaume de 9 a 11 hours and of 17 a 19 hours.

The company committee of Bicing in Barcelona has called 15 strike days of four hours per work shift, between days 12 i 31 of July, given the situation of economic precariousness and the unfortunate working conditions in Bicing de Barcelona and the lack of union response.

Of the 9 trade union delegates in Barcelona Bicing 6 they have been passed to the CGT, to be able to claim their rights. The Works Committee has held assemblies in the different work centers and shifts and the workers have shown their support for the strike call. The workers demand a real negotiation with the company and Barcelona City Council.

The unfortunate conditions of Bicing workers are among others: Salaries of 950 € per month. Loading and unloading powder from 23 kilos of bicycles. Unacceptable rhythms and organization of work, that breach the rules of prevention and the traffic code. Increased productivity in both mechanics, maintenance, as in mobility. Difficulties in being able to do the physiological needs during the working day and difficulties in being able to rest at breakfast time. Time organization of the company including overtime. The vehicles are not properly conditioned for the work they are intended for.

In a few words, 19th century labor relations in which they have been participating for a long time 11 years the American multinational Clear Channel and Barcelona City Council.

Fa 11 years that the staff call them "patience", that the economic and labor situation does not allow decent wages, that is not the time. Fa 11 years that the City Council set up the bicing with Jordi Hereu, Trias has passed and now those in the council are the ones who should put an end to the labor and economic precariousness of what has been reported to them in so many press conferences, but that when they are required to intervene they claim that it is managed by a private company.

Since all the doors have been closed, the workers have gone on strike, the company made a finalist proposal that was totally insufficient and that did not meet the expectations of the workforce, the involvement of Barcelona City Council has been requested and the workers have received silence in response. It is clear that with this salary, with these working conditions and with so many irregularities it is difficult to work.

From the CGT, union with the largest presence in the company both in terms of union delegates and affiliates, we defend the claims of the Bicing workers so that they have decent working conditions and end the precariousness they have been dragging for a long time 11 years.

Enough of broken promises, we want facts.

PROU IMPUNITAT PER JUSTIFICAR EL NEGOCI DE LA INFÀNCIA EN RISC

Des del Sector Social CGT, volem expressar el següent sobre les declaracions de la Consellera Dolors Bassa, arran de les nostres denúncies:

- El Sr Calvo, Director General de la DGAIA i la Consellera Bassa ens acusen de difamació. Malauradament no és difamació, denunciem el currículum objectiu del Sr Calvo.

El Sr Calvo i la Consellera Bassa en les seves declaracions s’obliden (voluntària o involuntàriament) que en Ricard Calvo no va ser tan sols director de projectes de FASI, va ser director adjunt i també director general. Durant el seu últim any dins la Fundació FASI es va contractar a una directora tècnica per alliberar-lo de les seves funcions com a director tècnic i adjunt, i així poder exercir de director general, en absència del Sr Estanis Vayreda, que recordem és director de SUMAR-Empresa d’Acció Social i exerceix de tinent d’alcalde de la ciutat d’Olot per l’antiga CDC. Malgrat que ja feia funcions de director general, just abans de ser nomenat per aquest càrrec, pel mateix Patronat de la Fundació FASI, el Sr Calvo marxa com a Director General de la DGAIA. Les educadores que han treballat a FASI i moltes altres que coneixem el projecte de Cases d’Infants sabem que el Sr Calvo ha estat i és un dels grans promotors i gestors, des dels seus inicis i fins a l’actualitat (d’on es troba en excedència) d’aquest projecte esquitxat de presumptes irregularitats, tal i com ha demostrat el prestigiós grup de periodistes Ramon Barnils en l’article publicat a: http://www.media.cat/2017/06/ , on es fa un estudi rigorós, i es corrobora com aquesta fundació paga lloguers desorbitats que quintupliquen el preu de mercat a una empresa immobiliària que és propietat de la mateixa Fundació FASI. O sia que es paga a sí mateixa lloguers inflats amb diner públic, sent una empresa amb ànim de lucre, mentre FASI retalla diners per les infants en risc, les seves famílies i les educadores socials que hi treballem. Per a nosaltres, això és una pràctica perversa i menyspreable: on es fa negoci amb el dolor d’un dels grups més febles de la nostra societat: la infància en risc.

toda la CGT Catalunya y confederal estatal, estamos atentos a las novedades que puedan surgir en torno al caso «Som 27 i més», ya que es inminente la convocatoria de tod@s l@s imputad@s a presentarse ante el juez, para el juicio oral, entre los que se encuentra nuestro compañero Ermengol Gassiot, secretario general de la CGT Catalunya. El Ermen está acusado como instigador del encierro llevado a cabo por estudiantes en el rectorado de la Universitat Autònoma de Barcelona, en el año 2013. Como profesor y trabajador del Departament de Prehistòria, el Ermen es delegado por la CGT. Tal como se dice en el comunicado del SP CGT Catalunya, el Ermen no se presentará al juicio oral, conciente de las consecuencias legales que eso conlleva, pero también conciente de quienes estamos a su lado.

Este es un montaje preparado por la UAB, universidad que tal como a ocurrido en todas las universidades públicas, se ha convertido en la formación superior de la burguesía y el caldo de cultivo donde las empresas se sirven a su gusto. La universidad pública, como el resto de niveles educativos, debe estar al servicio de la clase trabajadora, para la formación de individuos socialmente libres, y no al servicio de las empresas y corporaciones, que es lo que ocurre hoy en día.

Por eso desde la CGT Vallès Oriental impulsamos la defensa en la calle a nuestro compañero Ermen, porque no sólo representa a esa oposición al modelo educativo de universidad como empresa, sino porque además es Secretario General de la CGT de Catalunya.
Golpear al Ermen, es un golpe doble que nos hacen.

Por estos motivos, doble, y triple ha de ser nuestra respuesta!!
Porque ahora más que nunca, nos están tocando a todos y todas!

Desobedecemos el proceso político del caso “Som 27 i més”

Nuestro compañero Ermengol Gassiot ha decidido que no participará en la farsa y que no se personará en el juzgado por voluntad propia bajo ninguna circunstancia, afrontando las consecuencias que se deriven de su decisión.

Recientemente el juzgado de Cerdanyola que instruye el caso por el encierro de estudiantes en el rectorado de la Universidad Autónoma de Barcelona (UAB) del año 2013 (el caso conocido como “Som 27 i més”) ha dictado un auto donde se dispone la apertura del juicio oral y se fija una fianza absolutamente desproporcionada, from 511.835,05 EUR para asegurar las responsabilidades civiles. 27 personas encausadas a raíz de aquella protesta universitaria están a la espera de peticiones penales de entre 11 Y 14 años de prisión, depending on the case, y prohibición de acceso a la UAB durante 5 years. Entre ellas está nuestro Secretario General, el compañero Ermengol Gassiot. La fianza antes mencionada, como todo el mundo puede suponer, no será abonada por los 27 afectados y afectadas, lo que probablemente comportará procesos de embargo de nóminas y bienes.

Durante los próximos días o semanas las 27 personas serán emplazadas a personarse en dependencias judiciales para hacerles entrega de una copia de los escritos de acusación, a fin de que en el plazo de 3 días comparezcan con abogado y procurador, y sean requeridos para depositar la fianza.

Este Secretariado Permanente considera que todo este proceso no es sino un montaje motivado en una revancha política por parte del anterior rectorado ultraliberal de la UAB, orientado a escarmentar por la vía penal el movimiento estudiantil y el sindicalismo que le hacía frente en defensa de la universidad pública. La actuación de aquel rectorado, y el relato conspiranoico construido por los abogados que contrató a tal efecto, ha sido aprovechada por la Fiscalía, órgano político de España, para iniciar un esperpéntico procedimiento judicial que supone el peor caso de represión política en una universidad desde la época del franquismo.

Ante esta situación, nuestro compañero Ermengol Gassiot ha decidido que no participará en la farsa y que no se personará en el juzgado por voluntad propia bajo ninguna circunstancia, afrontando las consecuencias que se deriven de su decisión.

Este Secretariado Permanente comparte plenamente el análisis que sostiene la decisión tomada por nuestro compañero Ermengol, y apoyamos. Entendemos que ante un ataque de carácter político (instrumentado en forma de proceso judicial) contra las libertades y los derechos civiles es legítimo practicar la desobediencia y la solidaridad para impugnar públicamente la totalidad de este montaje represivo. Consideramos que en el momento presente nos estamos jugando buena parte del mensaje que se transmitirá a las luchas sociales que vendrán en el futuro sobre la respuesta que debe darse ante la represión político-judicial. Nos jugamos mucho, y las estrategias punitivas mediante las cuales se quiere paralizar y escarmentar cualquier tipo de resistencia sindical, estudiantil o social deben ser paradas. En el caso concreto del Ermengol, el presente montaje está orientado a reprimir el ejercicio de la acción sindical de la CGT en la UAB en defensa de los derechos de las trabajadoras y de la universidad pública y, más allá de ésta, lo consideramos un ataque al conjunto de nuestra organización.

Queremos dejar claro que, en la medida en que ello dependa de nosotros, ninguna de las 27 personas encausadas está ni estará nunca sola. Llamamos a todas las Federaciones y Sindicatos de la CGT, el conjunto de nuestra militancia, movimientos sociales y personas solidarias a preparar la respuesta colectiva y organizada que estos hechos se merecen. La CGT no quedará a la expectativa, ni quedará con los brazos cruzados. Nos reservamos el derecho, como organización, a actuar cuando y como lo consideramos oportuno, teniendo en cuenta la gravedad del caso.

La DGAIA maltracta i l’entramat del Sr. Ricard Calvo

TRETS, APUNYALAMENTS, PORTES GIRATÒRIES, I NOVES ADJUDICACIONS PER VALOR DE 98 MILIONS d’€ QUE BENEFICIEN AL CONGLOMERAT EMPRESARIAL AMB VINCLES AMB EL SR RICARD CALVO (DIRECTOR GENERAL DE LA DGAIA). FINS QUAN CONSELLERA BASSA HEM D’AGUANTAR TANTA INCOMPETÈNCIA?

Darrerament hem pogut llegir a la premsa notícies que, malauradament, confirmen tot el que venim denunciant des del Sector Social de CGT al voltant de la preocupant situació en que es troben els centres de menors tutelats per la Generalitat: “Tiros al aire de la policia en un centro de menores tutelados por la Generalitat”, “Polvorín en los centros de menores”, “Un menor tutelat, apunyalat al mig del carrer a Barcelona”, “La directora del Petit Príncep es va posar un sou que dobla el del conveni”, “La DGAIA diu que no controlen els salaris, ni els diners (que en les darreres adjudicacions arriben fins a 5.457 € per mes i per nen) donats a les fundacions privades que gestionen centres de menors, tot i que són diner públic”. “Fundacions del tercer sector paguen lloguers desorbitats a empreses participades per elles mateixes”.

Recentment, al CRAE Can Rubió un menor embogit es va fer amb una destral intentant agredir a d’altres infants i educadores, i es va necessitar la intervenció de la policia local i dels antidisturbis dels Mossos que van haver de fer trets a l’aire per dissuadir el menor i prendre-li l’arma. Aquest adolescent es manté al mateix centre després del greu incident. Al CRAE Sant Andreu un menor va passar per les finestres que donen al carrer un matxet de grans dimensions després de proferir amenaces de mort cap algunes educadores. Una arma que va ser intervinguda per educadores gràcies a l’avís d’altres adolescents. L’endemà van haver d’intervenir els mossos perquè aquest menor volia introduir una navalla al Centre. Tot això mentre seguia amenaçant a educadores davant dels mossos. Un adolescent amb una greu malaltia mental que ha amenaçat reiteradament tant a infants com educadores del mateix CRAE, però que malgrat aquests greus incidents segueix al centre; posant-se en perill la seva integritat física, així com la d’altres infants de només 8 years, i la d’educadores/rs. Aquestes notícies són la part més visible d’un sistema de protecció a la infància que revictimitza als infants i, lluny de protegir-los, els sotmet a un maltractament institucional.

Desobeïm el procés polític del cas 27 and more

Comunicat de l’SP de la CGT de Catalunya

Recentment el jutjat de Cerdanyola del Vallès que instrueix el cas per la tancada d’estudiants al rectorat de la Universitat Autònoma de Barcelona (UAB) de l’any 2013 (el cas conegut com a “27 and more”) ha dictat una interlocutòria on es disposa l’obertura del judici oral i es fixa una fiança absolutament desproporcionada, from 511.835,05 EUR per a assegurar les responsabilitats civils. 27 persones encausades arran d’aquella protesta universitària estan a l’espera de peticions penals d’entre 11 i 14 anys de presó, segons el cas, i prohibició d’accés a la UAB durant 5 years. Entre elles hi ha el nostre Secretari General, el company Ermengol Gassiot. La fiança abans esmentada, com tothom pot suposar, no serà abonada pels 27 afectats i afectades, la qual cosa probablement comportarà processos d’embargament de nòmines i béns.

Durant els propers dies o setmanes les 27 people seran emplaçades a personar-se en dependències judicials per a fer-los entrega d’una còpia dels escrits d’acusació, a fi que en el termini de 3 dies compareguin amb advocat i procurador, i siguin requerits per a dipositar la fiança.

Aquest Secretariat Permanent considera que tot aquest procés no és sinó un muntatge motivat en una revenja política per part de l’anterior rectorat ultraliberal de la UAB, orientat a escarmentar per la via penal el moviment estudiantil i el sindicalisme que li plantava cara en defensa de la universitat pública. L’actuació d’aquell rectorat, i el relat conspiranoïc construït pels advocats que va contractar a tal efecte, ha estat aprofitada per la Fiscalia, òrgan polític de l’Estat espanyol, per a iniciar un esperpèntic procediment judicial que suposa el pitjor cas de repressió política a una universitat des de l’època del franquisme.

Davant d’aquesta situació, el nostre company Ermengol Gassiot ha decidit que no participarà en la farsa i que no es personarà al jutjat per voluntat pròpia sota cap circumstància, tot afrontant les conseqüències que es derivin de la seva decisió.

Aquest Secretariat Permanent comparteix plenament l’anàlisi que sosté la decisió presa pel nostre company Ermengol, i hi donem suport. Entenem que davant d’un atac de caràcter polític (instrumentat en forma de procés judicial) contra les llibertats i els drets civils és legítim practicar la desobediència i la solidaritat per a impugnar públicament la totalitat d’aquest muntatge repressiu. Considerem que en el moment present ens estem jugant bona part del missatge que es transmetrà a les lluites socials que vindran en el futur sobre la resposta que cal donar davant la repressió político-judicial. Ens juguem molt, i les estratègies punitives mitjançant les quals es vol paralitzar i escarmentar qualsevol mena de resistència sindical, estudiantil o social han de ser aturades. En el cas concret de l’Ermengol, el present muntatge està orientat a reprimir l’exercici de l’acció sindical de la CGT a la UAB en defensa dels drets de les treballadores i de la universitat pública i, més enllà d’aquesta, el considerem un atac al conjunt de la nostra organització.

Volem deixar clar que, en la mesura en què això depengui de nosaltres, cap de les 27 persones encausades està ni estarà mai sola. Fem una crida a totes les Federacions i Sindicats de la CGT de Catalunya, al conjunt de la nostra militància, moviments socials i persones solidàries a preparar la resposta col·lectiva i organitzada que aquests fets es mereixen. La CGT de Catalunya no quedarà a l’expectativa, ni restarà amb els braços creuats. Ens reservem el dret, com a organització, a actuar quan i com ho considerem oportú, tenint en compte la gravetat del cas.

The reasons for the Barcelona Metro Strike

Ada Colau has gone from cataloging the year 2014 to the managers of the Barcelona Metro company as a 'mafia that needs to be kicked out', to support them and act against workers' strikes. What is the reason for this change??

In TMB there is 579 managers outside of agreement, many of them plugged in by PSC, ICV i CDC. People like Didac Pestanya, now retired, mayor of Gavà of the PSC during 20 years with a salary that amounted to more than €200,000.

Of 2011 these managers got a raise 15% while that of the template was still frozen, with 400 people hired on a precarious basis and strongly pressured (for example, pregnant women are denied job changes to keep staff to a minimum).

more 60 managers receive more salary than the mayoress of Barcelona. The City Council repeatedly violates the transparency law and does not publish the salaries of these managers, while criminalizing the workers. Ada Colau herself attacked the very concept of a strike saying “strike is not negotiated because it pressures”. Clar, Ada, that's what strikes do. She had the same opinion when she herself occupied her banking offices to stop evictions by putting pressure on a higher economic power?

Relationships with the bank seem to be great, T-Mobilitat is privatized in 'la Caixa' by 94 million euros.

They have occurred 68 agreement meetings without the city council wanting to close any solution, linking the interests of a management group with their own. Because?

Barcelona en Comú is practicing possibilism with the caste to organize the balance of interests in the city council. The winning bid included ICV, to which PSC later joined the councilorial government. Both parties have lived and live from a clientelism with 'their people' which they place in the different bodies to which they have access. And to our people, the TMB mafia that Colau was referring to, don't touch it.

The city council of Barcelona is currently the defense lawyer of a useless dandruff, incompetent and neoliberal who does not hesitate to seek confrontation with workers to defend his interests and those of his financial friends.

Mercedes Vidal, president of TMB, Marc Grau, director-pitbull of TMB, BEC, ICV, PSC, CDC is to blame for not wanting to find a solution to the situation.

Aquesta convocatòria estableix el procediment per ocupar vacants amb caràcter provisional a les escoles, centres d’educació especial, centres d’ensenyaments secundaris, centres de formació de persones adultes i altres vacants corresponents a llocs de treball dels cossos de mestres i de professors d’ensenyaments secundaris no ocupades amb caràcter definitiu o provisional per al curs 2017-2018.

Les destinacions provisionals són amb efectes d’1 de setembre de 2017 i finalitzaran el 31 August of 2018, a excepció dels casos previstos de propostes de l’Administració o dels directors dels centres per ocupar llocs per una durada superior.

One more year the CGT opens its Summer Libertarian School, a space for meeting and discussion, of learning and recreation, in which we can all contribute our experiences and knowledge to enrich each other.

This year, between 29 June and 2 of July, we will meet Ruesta (Pre-Aragonese Pyrenees) under the motto: Public services, Transnationals, Unemployment and Precariousness.

In recent years, we are witnessing the acceleration of the attack of capitalist globalization that, through Transnationals, performs on public services susceptible to general benefits. The looting of the commons, causes exclusion, unemployment and precariousness, condemning the 90% from population to poverty.

Faced with this situation this year the Libertarian School of CGT, through four workshops, we are going to reflect and debate what the CGT responses have to be, alternatives and strategies to combat this problem.

En las empresas se nos pretende imponer la “competitividad” como medida de todas las relaciones, y así se nos quiere aislar, romper los lazos de solidaridad de clase que es justamente nuestra fuerza.
